Unlawful Child Deportation from Israel

This article addresses unlawful child deportation from Israel, which is also called child abduction or kidnapping.  While people often envision strangers when they think of child kidnappers, legally speaking, this most often occurs when a parent or legal guardian removes children from their country of residence without the consent of the other parent or guardian who is practicing their custody rights.

What Is Unlawful Child Deportation

A child is considered unlawfully deported (or kidnapped) if they are removed from their primary country of residence without the consent of all parents or guardians with custody rights.  It is important to note that, if for example, a mother has visitation rights but never implements them, and the father moves abroad with the children, the courts may not order the children’s return, as the law specifically protects parents with custody rights that are already being implemented.  Additionally, if a child is taken from their country of residence with the agreement of all parents, but then one parent decides to retain the child outside of the country without the other parent’s permission, this is also considered abduction.

Protections around Unlawful Child Deportation from Israel

Israel has signed the Hague Convention, which was put in place and signed by numerous countries to protect children and custody rights of parents.  It indicates that courts should move quickly and countries can cooperate to restore children to their parents and habitual place of residence.  If the country to which your child was taken is not a signatory to the Hague Convention, you can still pursue legal action, however, it can take longer.
