Conditions required for the purpose of granting legal validity to the will

The law of succession in Israel defines five different types of wills, which are recognized by Israeli law as legal validity:

  1. Handwritten will – A will written entirely in handwriting by the testator.
  2. A Will with Witnesses – A will which at the time of signing is attended by two witnesses on behalf of the testator.
  3. A testament to authority – A will made to an “administrative officer” who may be a judge in an Israeli court, a member of a religious court, a court registrar or a notary.
  4. Oral Will – A will read orally by the testator in front of two witnesses. This will be recognized as legal only in cases where the legator is defined as a patient who tends to die.
  5. Mutual will – A will made by both spouses who rely on each other, or alternatively in one joint document. This testament was recognized by law in 2005. Read more about drafting a mutual will in Israel in this article, on our website.

How is inheritance distributed according to probate?

The law states that in any case where the will was not made on the basis of free and clear will of the testator, the will is not valid.
