Are You Summoned As Suspect or Witness?

If you have been summoned to be questioned at a police station in relation to a traffic violation, it is very important to ascertain whether you are being summoned as a suspect or as a witness.

If you have been summoned as a witness, then there is no need for you to prepare for the investigation or hire legal counsel. However, if you have been summoned as a suspect, you should contact an experienced traffic lawyer immediately.  You should also inquire what violation you are suspected of so that your attorney can better prepare you for the investigation. In Israel, you have the right to remain silent. However, sometimes your silence can be brought as evidence against you at court. Your attorney will advise you when it is best to remain silent and when it is best to be candid with the police. In any case, your words should be very measured, and you should not engage in any idle talk at the police precinct since anything you say can be used against you in court. 

If you have chosen to remain silent regarding a specific question, it is best to say that you are exercising your right to remain silent. The investigation is required to be in a language that you are comfortable with, and at the end of the investigation, you will be asked to sign a deposition detailing the contents of your conversation. Do not sign the deposition unless it accurately relays exactly what you said. Do not hesitate to make corrections and changes to the deposition.
