What Is Continuing Power of Attorney?

Continuing power of attorney, also commonly referred to as lasting power of attorney or enduring power of attorney, allows an individual who has their full mental capacity to decide who will make financial, personal and health decisions on their behalf when they are no longer mentally fit to make these decisions on their own. 

Why It’s Important

There are a number of important reasons to draw up a continuing power of attorney. 

First, it gives an individual the peace of mind that their preferences regarding their personal issues, health and estate will be maintained, even when they are no longer able to make these decisions on their own. 

Second, it allows the individual to choose the person (appointee) who will implement their wishes and will make decisions on their behalf. It also allows the individual to determine an apotropus, or legal guardian, which will have to obtain court approval to go into effect.  It is always better to choose this in advance, otherwise the court will make the decision on this issue, sometimes appointing an individual who is less than ideal for the position.  

Third, choosing the person who will help with an individual’s various needs and assets will give an individual’s family peace of mind, avoiding future arguments on the issue. 

Fourth, it saves time and money, as court proceedings to set a legal guardian and to consult with the legal guardian it appoints can take a lot of time, costing a lot in the process.

Who Can Draft It

Only lawyers who have gone through specific training are approved by the state to draw up a continuing power of attorney.  Our law firm has a number of lawyers who focus on this in particular, and who have obtained the requisite training and approval to do so.
