Injured in Car Accident in Israel

Background

Before 1975, in the event of an accident, one had to personally sue the driver of the offending vehicle to obtain compensation. Due to the legal system, it was complicated to prove the driver’s guilt, and many people ended up injured without compensation. Then, in 1975, Israel passed the Road Accident Victims Compensation Law to help with this. This law required all owners of vehicles to obtain obligatory insurance, also called bituach chova, which would allow someone to sue the insurance company to obtain compensation when injured.

Compensation for Injured in Car Accident in Israel

Compensation for someone injured in a car accident in Israel is determined based on a number of factors. This includes the severity of the injury, how much the person is unable to work or earn money due to their injury, the injured person’s age, the number of working years left until retirement (ie, the younger they are, the greater the compensation), and how much they earned before their injury, among other circumstances.

Insurance companies will often argue that a person’s injuries are less severe than they appear in order to pay the least money possible. This is why it’s essential to have a lawyer representing your interests to get the compensation you are entitled to.
