What Is a Notary Public and When Do You Need Them to Perform Signature Authentication?

A notary public is a lawyer with seniority and special certification from the Ministry of Justice attesting to their high reliability. Accordingly, authentication of documents and signatures performed by a notary public provides the highest level of certainty as to the contents of the documents and the identity of the signatories. This enables the authorities to formally recognize documents as authentic, which is why notarized authentication is often required for official applications.

There are various cases in which there is a need for signatures to be recognized by public authorities in Israel and abroad. Documents with such signatures may include wills, powers of attorney, prenuptial or postnuptial agreements, and translations of these documents. Sometimes it is also necessary to authenticate signatures on affidavits that are submitted to courts and authorities in Israel and in foreign countries (for example, our office regularly provides notary services for proceedings conducted in the United States). How Is Notarized Signature Authentication Performed?

The authentication process begins by presenting the notary public with identification documents and answering several questions. The document with the signature requiring authentication must also be presented. After that, the signature is authenticated. Both the notary public and the clients and witnesses (as required) must sign the authenticated document. The notary public then adds their stamp and seal. Additional changes or requirements may apply, depending on the specific service needed.

Also, since the document may later be used as evidence, the notary public is required (after completing the identity check) to verify that the clients sign the document of their own free will. In addition, in light of a recent amendment made to the Notaries Law and Notary Regulations, notarized signature authentication may now also be performed digitally. However, even in this case, the client is still required to have physically been present at the notary’s office for an identity check at some point. How Much Does Notarized Signature Authentication Cost?

Unlike other services offered by lawyers, notarized signature authentication has a fixed price list that is determined in the service-fee section in the Notary Regulations. As of 2021, the list price for authentication of a single signature is ILS 178 + VAT per document. Each additional signature raises the cost by ILS 70 + VAT. Each additional copy of the document costs ILS 70 + VAT. These costs do not include notarial translation services. What Do You Do When Witnesses Are Needed?

Signature authentication by a notary public often requires having witnesses sign the documents. Depending on the need in some cases, our firm assists in finding witnesses for this purpose. However, if witnesses are required not only for the purpose of signing documents but also for surety or any other matter, clients are required to find the witnesses themselves.
