Foreign Divorce in Israel

This article, Foreign Divorce in Israel, discusses obtaining recognition in Israel of a divorce conducted abroad. While obtaining a divorce judgment abroad ends a marriage, it is imperative to have this recognized and registered in Israel in order to allow a person to remarry in Israel.

A foreign divorce judgment must be registered in Israel within five years from the date it is issued.

Obtaining Recognition of a Foreign Divorce in Israel

Foreign Divorce in Israel

Israel only recognizes foreign divorces if the country where it was issued mutually recognizes Israel’s judgments. An Israeli court — either a family court for non-Jews or mixed-marriage couples or a rabbinical court for Jews — must recognize and validate the divorce judgment in order for official recognition to take place. The judgement requires a notarized translation into Hebrew (unless the original document was in English, in which case it will sometimes be accepted without a translation).

If you are not sure if Israel and the country in which the divorce was issued have mutual agreements, please contact us.

Registering the Divorce

There is a separate process to register a foreign divorce. This must occur at the Israeli Ministry of Interior. This will allow an individual to change their personal status to ‘divorced,’ proof that is required for various administrative purposes in other contexts.

It is important to note that a foreign divorce must be both recognized in an Israeli court and registered at the Ministry of Interior for a person to be considered legally divorced in the country and eligible to remarry.
