This article will discuss divorce between Jews in Israel. Unlike many Western countries, Israeli law allows Rabbinical Courts to have the primary authority over issues of divorce, although there are issues accompanying divorce that the Family Court can address as well.  

Procedure for Divorce Between Jews in Israel

Jewish couples who wish to divorce must go through the Rabbinic Court, regardless of how personal religious the spouses are. The divorce claim must be submitted to one of the 12 regional courts. The spouse filing the divorce is no required to inform the other spouse that they are initiating the divorce process. In order for the Rabbinic Court to move forward, the claim should also address other relevant issues, for example, custody if children are involved, division of assets, and more.  

If both parties are in agreement on issues like alimony, custody, division of assets, etc., they can both sign and authorize said agreement, only then submitting the divorce claim to the Court. This will allow the process to proceed quickly.  

It is possible to submit certain claims around divorce to the Family Court, addressing, for example, alimony, wills, and more, if a couple prefers for a civil rather than religious court to deal with this. Once a couple has obtained a signed ruling indicating what will be done around these issues, they can then file their divorce claim at the Rabbinic Court. If the Family Court has already addressed any outstanding issues, then the Rabbinic Court procedure will also move more quickly. However, the same divorce issues the Family Court deals with can also be dealt with through the Rabbinic Court.
