In our law office, we often see cases of child abduction from Israel when parents are divorced.  This is because child abduction, which refers to the removal of children from the country or retention of children outside of the country, often happens in cases where partners are no longer on good terms, are in the process of divorce, or are divorced.  A parent can make a case for child abduction when there are custody rights involved, the rights have been implemented prior to abduction, the rights were given by law in the habitual country of residence, and the abduction violates these custody rights. (It is important to note that if the other parent shares custody, but has not practiced their custody rights prior to the children being removed or retained abroad, this will weaken the case of the parent who has not implemented custody rights.)

Laws Protecting Parents and Custody Rights

The Hague Convention and Israeli law seek to protect the wellbeing of children and the custody rights of parents.  These regulations urge immediate action by the offended party. These laws seek to protect the physical and psychological wellbeing of children who are uprooted from their permanent residence during the abduction process.  Israeli courts are required to request that the children be returned immediately, and they work in conjunction with authorities in the country to which the children were taken.

What the Hague Convention Does

Israel is a signatory to the Hague Convention, as are many other countries around the world.  This means that they work in cooperation around cases of child abduction, speeding up the legal processes to return children to their permanent residence as quickly as possible.  If a parent’s children are abducted to a country that is not a signatory to the Hague Convention, Israeli authorities can still take legal action, but the process is much more complex and takes a longer period of time.
