What Is an Israeli Bank Guarantee?

A Ministry of Interior Israeli bank guarantee is an agreement between the guarantor and the Ministry of Interior, where the one depositing the guarantee agrees that the Ministry of Interior may foreclose the guarantee (that is, take the guarantee funds) when certain conditions are met. In simple words, a man who invites a foreign citizen to visit Israel is required to guarantee in advance that if the foreign citizen does not leave the country before the visa’s expiration date, the state would be permitted to take the sum of money that was deposited beforehand.

When Do the Ministry of Interior Workers Require Depositing a Bank Guarantee?

The Ministry of Interior’s regulations outline various situations in which it is necessary to deposit an Israeli bank guarantee by an Israeli citizen or resident who invites a citizen from another country to visit Israel. As a general rule, the Ministry of Interior’s officials use their discretion in each case and assess whether there is concern about illegal settlement in the country. In case of such concern, the requirement to deposit an Israeli bank guarantee for the Ministry of Interior will arise.

From the viewpoint of the Ministry of Interior, depositing the Israeli bank guarantee serves as security to increase the chances of departure from Israel at the legal date, according to the visa issued. A person who enters Israel but is stopped at the border crossing for fear of their illegally settling in Israel or for fear that they came to work here illegally might be required to deposit a bank guarantee to ensure departure from Israel on time.

What Is the Amount of the Bank Guarantee?

There is no standard sum in the law or in the Ministry of Interior’s regulations regarding the amount of the Israeli bank guarantee that is deposited with the Ministry of Interior. The ruling determines that the amount of the guarantee should reflect the financial ability of the one depositing the guarantee. Therefore, a man of means will be required to deposit a high bank guarantee as opposed to those who have little means and for whom a lower sum can be sufficient. That said, it must also be stated that the sum of guarantee is usually tens of thousands of shekels.

How Is the Ministry of Interior Bank Guarantee Deposited?

A Ministry of Interior Israeli bank guarantee is usually withdrawn from the bank account of the one depositing the bank guarantee. First of all, care must be taken that the sum of money is in the bank account, and secondly, a guarantee form is signed in conjunction with the bank, according to which, upon request of the Ministry of Interior, the bank commits to transfer the guarantee funds to the state without delay. After signing the Ministry of Interior bank guarantee form, the sum of the guarantee is frozen in the bank account, and the guarantee money is not available for use.

A second option for depositing a Ministry of Interior bank guarantee is done directly in conjunction with the Population and Immigration Authority Office of the Ministry of Interior in  Ben Gurion Airport, where it is possible to deposit a bank guarantee in cash.

In What Situations Does the Ministry of Interior Take the Bank Guarantee Money?

A bank guarantee for the Ministry of Interior helps to ensure departure from Israel at the required time. The Ministry of Interior is permitted to foreclose the Israeli bank guarantee money according to the bank guarantee agreement and its guarantee conditions. If the guarantee agreement determines that the one depositing the guarantee commits to leave the country up until a certain date, but it is discovered that the person is still in Israel after that date, the Ministry of Interior is permitted to foreclose the bank guarantee.

How Can You Recover the Bank Guarantee Money?

After the bank guarantee period is over, and under the assumption that the one depositing the guarantee has not violated its conditions, then the one depositing the guarantee requests that the Ministry of Interior recover the guarantee money deposited with them.
